Termination of Jin Shin


Dear Jim:

The termination of Jin Shin, on June 11 2004, from her employment with the Montgomery County government has been brought to our attention.

According to the Termination memorandum, signed by Frances V Pierce, Register of Wills, Ms Shin was "officially terminated" due to the following five (5) reasons as quoted below:

  1. Unprofessional Behavior - counter and phones
  2. Poor Job Performance
  3. Failure to work independently
  4. Cannot accept correction when needed.
  5. Unable to be given additional responsibilities, due to poor job performance

Jin Shin began her successful employment with the Montgomery County government in December 2000.

The enumerated "reasons" seem prima facie to be thinly-veiled pretexts for a discriminatory and unlawful termination.

Hence, we ask you to, effective immediately, reinstate Ms Shin with any and all lost wages, benefits and/or otherwise deemed adequate, due and proper.

We await your prompt attention onto this matter. Thank you.

Dear Jim:

Papers made preliminarily available indicate the following:

  1. Jin Shin was hired by Montgomery County on or about December 2000.
  2. Frances V Pierce, Register of Wills Montgomery County, became Jin Shin's supervisor on or about March 2004.
  3. Frances V Pierce placed Jin Shin on a suspension on or about May 21, 2004.
  4. Jin Shin was placed on a probation on or about May 28, 2004.
  5. Frances V Pierce issued a termination of Jin Shin's employment in about 5 minutes or so after a grievance meeting commenced on or about June 11, 2004.
In this context, we ask you to answer the following:
  1. Did you authorize and sanction Frances V Pierce to place Jin Shin on a suspension (May 21) and a probation (May 28) and then terminate her (June 11)?
  2. Would you make available copy of job performance evaluation of Frances V Pierce?
  3. Would you make available copy of job performance evaluation of Jin Shin?
In addition, we continue to ask you to make available copy of Montgomery County's/your office's implementation policy of Title VI LEP based on Executive Order 13166? You may send the material to

Dear Jim:

Papers made preliminarily available indicate the following:
  1. Montgomery County employed Jin Shin as a clerk and paid her at the final rate of $21, 000 per year from December 2000 through June 11, 2004 when Montgomery County, under your watch, unlawfully engaged in a discriminatory action against her and wrongfully terminated her.
  2. Office of Employment Security Commonwealth of Pennsylvania issued a determination in her favour.
  3. Montgomery County, under your watch, relentlessly continued to engage in a discriminatory action against her and deprived her of the benefits in retaliation against her.
In this context, we ask you to answer the following:

  1. Are you in the business of practising discrimination and retaliation against a person who may appear to be prima facie unable to defend herself vis-a-vis your underlings' shenanigans in complicity under your watch?
  2. Hence, we ask you to, effective immediately, reinstate Ms Shin with any and all lost wages, benefits and/or otherwise deemed adequate, due and proper. Would you?

Termination of Jin Shin


Dear Jim:

Papers made preliminarily available indicate the following:
  1. Montgomery County employed Jin Shin as a clerk and paid her at the final rate of $21, 000 per year from December 2000 through June 11, 2004 when Montgomery County, under your watch, unlawfully engaged in a discriminatory action against her and wrongfully terminated her.
  2. Office of Employment Security Commonwealth of Pennsylvania issued a determination in her favour.
  3. Montgomery County, under your watch, relentlessly continued to engage in a discriminatory action against her and deprived her of the benefits in retaliation against her.
In this context, we ask you to answer the following:

  1. Are you in the business of practising discrimination and retaliation against a person who may appear to be prima facie unable to defend herself vis-a-vis your underlings' shenanigans in complicity under your watch?
  2. Hence, we ask you to, effective immediately, reinstate Ms Shin with any and all lost wages, benefits and/or otherwise deemed adequate, due and proper. Would you?
We will thank you for your prompt attention onto this matter.

We have come to learn that you apparently made an overture to Jin Shin through your agent to the effect that you would be willing to get her job back provided she would execute a document - prepared by you/your legal team - relinquishing certain of her legal rights.

Should that be the case, we ask you to put that in writing and mail to CAMC at your earliest convenience as you did previously. Thank you.
